03.31.09 - Mr. Preston wins appeal in the Tennessee Court of Appeals on March 31, 2009 in Sameh Akladyous and Ashraf Roufail v. GTech Corporation and Specialized Communications Companies, Inc. This case was appealed by the Plaintiffs to the Court of Appeals from a Summary Judgment. Mr. Preston was retained to represent the Plaintiffs on appeal. The Court of Appeals reversed the Trial Court and remanded the case to the Trial Court. The Court of Appeals Opinion is linked here.
02.03.09 - United States District Court Judge Aleta Trauger grants Mr. Preston’s Motion to Remand the case of Babailov v. Mohawk Industries, Inc. and Jeffrey Lorberbaum back to the Third Circuit for Davidson County, Tennessee at Nashville. Igor Babailov v. Mohawk Industries, Inc. and Jeffrey Lorberbaum was originally filed in the Davidson County Circuit Court, Case No.: 09C369 on February 3, 2009. The Defendants removed the case to the United District Court for the Middle District of Tennessee on February 27, 2009. Mr. Preston, on behalf of Igor Babailov, filed a Motion to Remand the case back to the Davidson County Circuit Court. Judge Trauger granted Mr. Preston’s Motion on April 3, 2009. United States District Court Judge Robert Echols granted the Plaintiffs’ request for an injunction against Carl Tilley, the Tilley Foundation, Inc. and other defendants after a hearing on the matter on
September 29, 2006
. The Plaintiffs sought an injunction against the Defendants from dissipating, wasting and transferring the assets of the Tilley Foundation, Inc. or of Carl Tilley and his wife Katherine.
